Nevada court hears ‘personhood’ measure appeal

Proponents of a ballot initiative to reshape Nevada abortion law asked the state Supreme Court on Tuesday to focus on the eight words that they said clearly define their goal.

"The term 'person' applies to every human being," Personhood Nevada leader Olaf Vancura said afterward, using the same eight words outside the state high court that are the focus of his group's appeal. He wants to be allowed to collect signatures to qualify the initiative for the November ballot.

In court, an American Civil Liberties Union of Nevada lawyer told the seven justices that voters wouldn't know that amending the Nevada Constitution to define "personhood" as beginning at conception would let advocates advance efforts to ban abortions, restrict common forms of birth control and affect end-of-life questions.

"These are hot-button, critical issues," ACLU attorney Lee Rowland said, urging the state's only appellate court to uphold a lower court ruling in January that the initiative is vague and violates state law limiting ballot questions to one subject.

"There needs to be some information in there that lets the voters know what's going on," Rowland said.

Justices appeared skeptical of overruling the lower court based on Personhood Nevada lawyer Michael Peters' argument that the lower court judge erred in examining anything more than the legality of the wording.

Justice James Hardesty asked Peters if there was a difference between considering the constitutionality of the proposed initiative and determining whether it "impacts other provisions in our laws beyond the stated purpose of the initiative."

"You're limited in looking at, in this case, the eight operative words in determining the single subject," Peters responded. "It's an 'on-its-face' analysis."

"Does this fully inform the voters, ultimately, as to what they're voting on, what they're amending in the Constitution?" Justice Michael Douglas asked. "Or is it so open-ended that they're not sure what the meaning is?"

Peters told Douglas, the first black justice on the Nevada Supreme Court, that the initiative aimed to extend civil rights to a person at conception.

"In essence you're asking us to define when life begins," Douglas said. "Does it do that? Is it clear in all cases?"

"It does define human beings and when life begins," Peters responded.

More than 50 people ranging from right-to-life advocates to Planned Parenthood representatives filled the courtroom gallery for the oral arguments in Las Vegas.

A day earlier, another branch of the national organization Personhood USA gained enough signatures to put an anti-abortion proposal on the Mississippi ballot in 2011.

A similar proposal goes before Colorado voters this fall, and Personhood USA leader Keith Mason said signatures were being gathered for constitutional amendments in Missouri, California, Florida and Montana. Mason tallied about 40 states in which the organization was working toward changing laws.

Rowland urged the Nevada high court to consider the effects of eight words "that are only fleshed out and that only have meaning once you read the description of effects."

"So your argument is that the sentence encompasses more than a single subject?" asked Hardesty, who posed most of the questions during the 30-minute hearing.

"Absolutely," Rowland replied. "Allowing it to go through simply because of its brevity, I think, poses a very real danger to the citizens of Nevada, which is that the initiative process starts to be used for vague, semantic and theoretical ideas."

If ‘personhood’ is defined as beginning at conception will that mean that the 20 to 30% of the fertilized eggs that aren’t implanted or that are spontaneously aborted (miscarried) many of which a woman is unaware of will require funerals? If so, how will anyone know? Will Rush Limbaugh, Pat Robertson, James Dobson or other men of that persuasion (the Conception Cops) be checking every woman’s required pregnancy test to see who conceived? Additionally ‘personhood’ would set the stage to promote the erroneous claim by radical conservatives that hormonal birth control is an abortifacient!



DA's sex Ed warning befuddles Wis. teachers, kids

MAUSTON, Wis. – Mike Taake has taught sex education for 30 years, and he says he knows what doesn't work: just telling kids to wait.

The Mauston High School health teacher has used abstinence-only and comprehensive curriculums, and he said students need all the information they can get about sex to make the best choices. But teaching them about contraceptives could land him and other teachers in court.

Juneau County District Attorney Scott Southworth last month sent a letter to area school districts warning that health teachers who tell students how to put on a condom or take birth-control pills could face criminal charges. The warning has befuddled teachers, school administrators and parents in Southworth's poor, rural county.

"Seems like a step back in time," Taake said of Southworth's logic.

Southworth, a Republican and a Christian evangelical, took issue with a law Democratic Gov. Jim Doyle signed in February requiring schools that teach sexual education to adopt a comprehensive approach.

Southworth warned that teaching a student how to properly use contraceptives would be contributing to the delinquency of a minor, a misdemeanor punishable by up to nine months behind bars and a $10,000 fine. He said it would be promoting sex among minors, who are not legally allowed to have sex in Wisconsin.

"It puts the school kind of in the middle between two sides, between the government and state telling us what should be taught and what people think should not be taught," said Scott Lenz, a health teacher in the New Lisbon School District. He said he would teach contraceptive use if he got the approval of his school board.

Southworth said he doesn't want to drag teachers into court but feels he was ethically responsible for warning them of the new law's potential consequences. He urged the school districts to refrain from offering sex education courses until the Legislature repeals the law.

"Listen, there's a real problem with the law," he said. "I didn't pick the fight. The Legislature dumped it in my lap."

Southworth didn't cite evidence in his letter showing that teaching someone to use contraceptives makes them more likely to have sex. But in an interview Thursday, he pointed to Milwaukee Public Schools, which teach a comprehensive sex education curriculum but still struggle with high teen pregnancy rates. Sex education experts, however, say many social factors influence teens' decisions to have sex, including lack of parental supervision and poverty.

Janine Geske, a Marquette University law professor and former state Supreme Court justice, said she didn't understand Southworth's legal logic. She said that if he tried to prosecute a teacher for adhering to guidelines approved by the Legislature and governor, the case would likely be dismissed.

"To be frank, I can't follow exactly what he's trying to get at," Geske said. "If a teacher is educating a student pursuant to state law ... I don't see how under any examination (that) could be criminal."

The state Legislative Council, a group of attorneys that provides legal advice to state lawmakers, issued a statement Friday saying it also believes teachers who follow the state guidelines would be safe from prosecution.

In Wisconsin, children under age 17 who have sex with each other can be prosecuted as juveniles. Seventeen-year-olds who have sex with one another can be convicted as adults of a misdemeanor.

Wisconsin schools aren't required to teach sex education. But under the new law, which was backed by Planned Parenthood of Wisconsin, schools that do must teach a range of topics, including the benefits of abstinence, the proper use of contraceptives, how to make responsible decisions and the criminal penalties for underage sex. Parents can choose to keep their children out of the classes.

Juneau County lies in the woods and bluffs about halfway between Madison, the state capital, and the Minnesota border. The teen birth rate here in 2008 was nearly 34 per every 1,000 births compared with the state rate of nearly 31 per 1,000, according to a report last year by the county and the University of Wisconsin School of Medicine and Public Health.

The county is about evenly divided between Democrats and Republicans. Voters narrowly backed former President George W. Bush in the 2000 and 2004 elections, but sided with President Barack Obama in 2008.

Southworth says he's not trying to bolster his reputation as a social conservative for a potential run for higher office, his stance has proved popular with anti-abortion groups.
Matt Sande, the legislative director of Pro-Life Wisconsin, which opposes the new law, said every district attorney in Wisconsin should follow Southworth's lead.

"We commend him for his courage, his frankness in exposing the consequences of this irresponsible new law," Sande said. "If I were a district administrator, I would want to know the impact."

And Janet McCauley, a speech teacher in the Mauston district, said she thinks the new sex education guidelines promote "sexual curiosity" and that Southworth's warning was necessary.

"This is dangerous to our young people. I just think the whole bill wasn't thought out enough."

But many parents said they were befuddled by Southworth's warning.

Audrey Jensen, whose 16-year-old daughter, Justina, is a sophomore at Mauston High School, said Southworth is trying to censor what students learn, usurping the role of parents. Children will have sex regardless, she said, and they need all the information they can get.

"I think he's actually a little unrealistic," said Jensen, 47. "Obviously he doesn't remember being a teenager."

Mauston High School quarterback Brady Nelson, 16, said sex education doesn't encourage teens to do it and Southworth should leave health teachers alone.

"It teaches you more about the bad side of it than the good," he said. "You're not going to learn any other way. You can't really charge a teacher for teaching us about the ways of life."

Taake said he intends to teach contraceptive use and isn't worried about being prosecuted.
"It's not just teaching them how birth control works. It's everything else that goes with it," he said. "To arrest me for teaching correct birth control and the student makes the wrong decision and gets pregnant, that's not my decision."

Personal comment: “Southworth, a Republican and a Christian evangelical” is undoubtedly attempting to burnish his conservative credentials with the intention of a career in politics. In the process he is trying to limit the effectiveness of his communities Sex Ed program by throwing up legal straw men and that’s a huge shame. It’s this sort of thinking that has kept the unintended pregnancy rate in the U.S. so high. Religious narrow-mindedness gives organized religion a very bad name.

And that has gotten the attention of the men controlling the action to the extent that they have put a price of $50,000 on his head. It’s a toss up as to whether the bosses are more upset about losing the three girls and their revenue stream or the fact that if the public finds out there is a serial killer stalking high-end professionals there will be a wholesale decrease in traffic as clients feel it’s safer to get serviced elsewhere.

The Casino is now screening our escort’s clients for them. We have always provided that service but until now a large percentage of escorts thought screening was too invasive and didn’t want it known who their clients are. Since the cunt hunter has been active the percentage of girls using our confidential client screening has gone from 43% to 78%. Some girls who believe themselves to be in the target population are taking precautions by wearing RapeX condoms when out and about. And, so far none of the dead escorts had sex with their killer, at least not shortly before they were killed.

A souvenir: The cunt hunter’s signature is the taking of the victim’s right shoe, presumably as a trophy with her left shoe stuffed in her mouth. He leaves no semen inside his victims but he may masturbate during the kill or afterward, though no semen has been identified as his. A lot of semen has been found and has been traced back to earlier clients who all have alibis that rule them out as the killer. That’s another reason we need this guy found, it spooks clients to find they need an alibi after spending that much money for sex. Though so far the clients have all been supportive saying what a shame the deaths were and all regretted the loss of that level of talent to the profession. I understand all were regular clients and have signed up for dates with their next fave escort and it appears there hasn’t been a noticeable dip in revenue among the rest of the highly skilled girls, at least not yet. However, there is a pattern with the killer. He seems to be into killing escorts who wear pointes of one sort or another.

My psychiatrist says that the pointe shoe as trophy fixation may indicate a guy who wanted to be a ballet dancer and has gone from a love of dancers to a pathological hatred of them. Or, someone with a morbid way of adding to his collection of pointes, needing to remove them from the corpse of a fresh kill. Though if that were the case I would think he would want the pair not just one, but then maybe he has a space problem at home. Or, perhaps he was abused by a woman, his mom or a nanny or an older sister, wearing pointe shoes when he was little. Or, perhaps he has been rebuffed in his sexual advances to ballet girls and he is taking revenge on any women in pointes by over-reacting now. Whatever has driven his infatuation with pointe shoes as trophies he is causing us a considerable problem.

The first trophy: So far he has taken a pool-pointe from a gorgeous and very experienced 35 y/o ballet dancer/diver whose specialty was pool-sex. She was found at the bottom of the pool in a casino’s vacant pool bungalows (fortunately not at my casino) suffocated with her air turned off and her jaws forced open and the toe-box of her left pool-pointe shoved between her jaws. He must have immobilized her until she suffocated with her regulator still in her mouth because there was no water in her lungs.

The second trophy: The second victim was a 25 y/o ballet/showgirl from another casino who was making three times her casino salary as an escort after hours and had intended to stop dancing - which she was doing as a form of publicizing her body and flexibility - because her career as an escort was so much more lucrative. She was found with her wrists bound to the barre (by the ribbons of a pair of her Gaynor Minden pointes) in a ballet studio where she trained in the very early morning after her shows. There was a bruise on her neck where her attacker had pressed on her carotid artery until she died from lack of oxygen to her brain. She has apparently been wearing Freed Classics (size 4 X) as her toes were taped and there was still padding in the left shoe the block of which had been forced between her jaws and the ribbons left hanging down onto her bare breasts where her top had been torn away. The Right Freed was missing.

The third trophy: The third victim was found in her own home. She had recently moved into a lovely three bedroom house which she bought as a foreclosure at a great price in a lovely neighborhood that hadn’t been hurt by the residential real estate collapse. She was a lovely 28 y/o hardbody who was making a name for herself as a knife-pointe fighter and spent most of her time training in KP-pointe boots at Gepettos. The organization is really shaking the bushes to find this guy (everyone assumes it’s a guy because of the pointe shoe fetish thing) so we may have some leads soon. DMC Pharmacy, a pro-life Catholic pharmacy that opened with much fanfare in Chantilly, Va., in October 2008, closed last month because of lack of funds.

"We could not make it work financially," said Robert Laird, executive director for the pharmacy, whose letters stood for Divine Mercy Care. "We could never get that big push to make it viable and finally the board of directors said enough was enough."

By the time the store closed March 4, it was losing in the tens of thousands of dollars per month. When it opened 18 months ago at a cost of $350,000 just as the national economy was in a free fall, the 1,500-square-foot store on Metrotech Drive did not stock birth control pills, condoms, cigarettes or pornographic magazines.

It did have booklets on natural family planning below a picture of St. John Leonardi, the patron saint of pharmacists.

It was one of seven pharmacies in the country that refused to dispense contraceptives for moral reasons, on the grounds they caused abortions, lead to promiscuity or endangered a woman's health.

Situated next to a Catholic bookstore, the founders hoped to attract clientele from St. Timothy and St. Veronica, two nearby Catholic parishes totaling 20,000 members. Within five miles were four other booming churches with 30,000 Catholics. And it was situated in the fast-growing Diocese of Arlington with 428,417 adherents. But regular customers never materialized in great numbers.

"You would have thought we could have made it happen," Mr. Laird admitted. "We were a niche. We were set up to cater to those who wanted that type of personal service. Once people came in, it was great. The pharmacist did so much more than dispense drugs."

But most customers only needed occasional medications and DMC never connected, he said, with patients needing the kind of maintenance medications that are the bread and butter for most pharmacies.

Plus, DMC never got into the heavy retail items, such as cosmetics, toys and fast food, that help keep similar pharmacies afloat. It did develop a mail-order business that, by the time the pharmacy closed, comprised almost 50 percent of the practice.

Robert Semler, the pharmacist who with his wife, Pam, kept the store going, is taking a much-needed break, Mr. Laird said, adding DMC still has "some debt" left over.

"It was hard," he said of the closing. "It was like a funeral."

Uhhh… what sort of personal service is that? NOT selling something? Go figure! To me that seems very judgmental of others private lives and not the sort of people that most women would feel comfortable in dealing with. They know to never leave their dive gear unattended and both are wearing tracker chips in their gas guards as well as the GPS chips in their cells and phone in regularly when with adults and teens they don’t know, so I feel they are as safe as it’s possible for a 16 y/o to be in a place as predatory as Vegas.

A reader asked: "Can foreplay with water jets decrease NuvaRing effectiveness?" If the water temperature is cool and the jets are applied briefly it shouldn’t decrease the effectiveness of NuvaRing. But, hot water – above body temperature - will cause the hormones to be released from the ring at a faster rate than normal and the ring may not protect the wearer for the entire wearing interval.

However, there could be a more serious problem with water jets if they are any more powerful than is produced from a douche bag. That’s because water could be forced into the woman’s uterus and cause an infection that could scar her tubes leading to sterility. A woman using NuvaRing can remove it for an interval up to three hours with no decrease in her protection. If you want to play with water jets up the vagina my advice would be to be fitted for a diaphragm or FemCap to use as a gas guard. That way the ring can be removed and the gas guard inserted to protect the cervix by preventing anything being forced into the uterus by the water pressure during foreplay. If the ring is removed it’s important that the woman remember to reinsert her ring within the three hour interval to retain her hormonal protection.

The popularity of gas masks and rebreather bags: I’ve been repeatedly asked why a gas mask and rebreather bag combination is such a popular fetish with a partner or for solo use. Breathplay while soloing in a bondage situation can be especially hazardous if the player hasn’t thought the whole scenario out in advance and left him or herself a way to open the valve on a sealed mask or rebreather, or s/he waits too long savoring the asphyxia high before trying to loosen the bonds enough to open the valve.

We have recently seen indications of masks ‘spider’ (head harness) tampering with the strap adjustment clips bent so that they can’t be loosened and the quick disconnect latches disabled so the wearer can’t get it off quickly. Not testing to see if escaping from a mask is possible before escape is needed can be a fatal mistake. Breaking the seal and getting out of a new polycarbonate gas mask that has been tampered with can be a slow process even before running out of air and when the wearer is breathless it’s to die for.

For fetishists who are divers and have their own SCUBA equipment using a full face mask (FFM) and a nearly empty air tank works extremely well for breathplay and is every bit as fatal if misused. A nearly empty tank is especially erotic giving the breathplay fetishist the audible hiss of the demand valve working as well as the increasing effort to suck gas as the tank empties and the pressure drops while s/he masturbates or a partner takes the player to orgasm. Degassing with pure oxygen: To speed up purging nitrogen from my body so I can spend more time underwater sucking gas from a SCUBA set I’ve started nitrogen degassing by breathing pure oxygen. There are several problems with breathing pure oxygen, oxygen toxicity and the very real risk of a flash fire because of the flammable nature of oxygen. I wear a small oxygen tank that feeds an Ocean Reef Neptune Space Raptor FFM (the black one) that has the standard upgrade for Nitrox and Trimix gasses. Breathing corrosive gasses the seals and metal parts have to be checked frequently so I use this Raptor strictly for flushing out nitrogen while I ride a stationary bike or exercise at the barre to keep my heart rate up. I don’t use any electronics in the mask to prevent the possibility of a spark igniting the oxygen. So far I’ve been able to cut my degassing interval by about a third.

In my 68 ft deep pool, ‘the Pit’ and at Adolph’s 200 ft deep discipline training facility, ‘the well’, at decompression stops above 50 feet during ascent I’ve started switching from Trimix to oxygen (from pre-positioned decompression tanks) to begin the process of purging nitrogen and have deactivated the thermocline (with its 65° water at the bottom of the pit) and increased the temperature throughout the entire depth to 95° so that the chilling effect of breathing Trimix is almost entirely offset even when wearing only a bikini. And a great thing about breathing Trimix is that the heat transfer properties of Trimix prevent overheating during energetic sex in 95° water. Adolph has turned his training facility heaters up too so that divers are comfy while in bikinis or slingshots. He didn’t want to do it at first but found that when chilled even he couldn’t keep an erection long enough to penetrate his partner no matter how horny he is so he finally gave in.

Open water nitrous oxide diving: Abi has already ignored all reasonable diving safety precautions by taking her Towel-Girl underwater bondage students on an open water bondage training class breathing 5% nitrous oxide to give the girls a buzz and remove any inhibitions, but not enough to anesthetize them. Against my advice Gigi went along and afterward told me what happened. The idea was to ease the student into a rather scary bondage situation with out totally freaking them out: dive-sex while fastened to a rock ledge 40 feet below the surface in cold water and with poor visibility. Breathing N2O while diving is extremely dangerous primarily because it dulls the mind at a time when the diver is in a hostile environment and needs to be as sharp and alert as possible. With a 5% mix of N2O and regular (21% oxygen) air a 95 to 110 lb woman will usually feel slightly euphoric and her normal cautionary skills are suppressed leading to all sorts of erratic and dangerous behavior.

The problem is that N2O needs to be blended for each person breathing it and girls with different weights and metabolisms can have different reactions to the same amount of gas. The predictable result was that some girls hardly got any buzz and their thought processes were just impared enough to be a danger to themselves and their dive buddys while a few others were so nearly anesthatized that they kept forgetting where they where and would try and wander off. All the TGs wore locator becons and recievers so if a girl became seperated from the group she would know in which direction to swim to get back to the group and could be easily located if she didn’t return.

Adolph let them use his place at Lake Tahoe and the cove area is rocky and the bottom is rock as well and drops off sharply with a cliff a few yards off his shoreline. Because the girls, buzzed on N2O, would not be stable either on their feet or in the water they all wore helmets as well as FFMs to cushion any collision with rocky surfaces. The FFMs also prevented a girl from accidentally expelling her reg. while in bondage where she couldn’t reinsert it. The TG in the image accompanying this entry is on her knees because she was so buzzed that if she hadn’t been on her knees she would have been on her ass.

After Gigi finished strapping the last of her friends to the ledge it was her turn and as Abi finished fastening the Velcro closures binding her on her back ready for penetration in missionary the men appeared out of the gloom.

Gigi said that there was a very slight sweetness to the gas she was sucking through her demand valve which was the N2O she could taste. She had no idea who the man was who was her partner for that UB lesson. All Abi would tell her was that the guys were clean and very experienced and Gigi’s partner was a good and considerate lover. She said she was amazed that being strapped down lying on her air tank was as comfortable as it was and attributed it to the ergometric design of the backboard.
